Welcome to Nieves Effect LLC. By accessing our website at www.nieveseffect.com or using our coaching services, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. About Nieves Effect LLC

Nieves Effect LLC is an online fitness coaching company operated by Felix Nieves, a certified personal trainer based in Tampa, Florida. We provide fat loss coaching, personalized workout programming, nutrition guidance, and wellness support delivered primarily online via our coaching platform and mobile application.

Our coaching services are designed to help adults achieve sustainable body transformation through evidence-based training and lifestyle strategies. Our programs are not a substitute for medical advice, diagnosis, or treatment.

2. SMS Messaging Program

Opt-out instructions: You can cancel the SMS service at any time. Just text "STOP" to our messaging number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to rejoin, sign up again via our website form.

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].

By providing your phone number and checking the SMS consent checkbox on our coaching application form, you consent to receive text messages from Nieves Effect LLC. Consent to receive SMS messages is not required to submit our form, receive coaching, or use our services.

We send two types of SMS messages:

  • Transactional messages: Appointment reminders, order confirmations, account notifications, coaching updates, and program instructions. Sent only if you checked the transactional SMS consent box.
  • Marketing messages: Special offers, discounts, promotional content, and service announcements. Sent only if you checked the marketing SMS consent box.
Carrier liability: Carriers are not liable for delayed or undelivered messages.
Message frequency & rates: Message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages that vary in frequency based on your coaching program — typically 1 to 4 messages per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. Services & Coaching

Nieves Effect LLC provides personalized online fitness coaching including but not limited to:

  • Custom workout and training programming
  • Nutritional guidance and meal frameworks
  • Habit and lifestyle coaching
  • Progress tracking and accountability check-ins
  • Access to the Nieves Effect coaching app

Results vary by individual. Nieves Effect LLC makes no guarantees of specific results. Client results depend on adherence, individual physiology, and other factors outside our control.

4. Health Disclaimer

Our fitness and nutrition guidance is for informational and coaching purposes only. Always consult with a qualified medical professional before beginning any exercise or nutrition program, particularly if you have any pre-existing health conditions or injuries. Nieves Effect LLC is not responsible for any injury, illness, or adverse outcome resulting from following our coaching recommendations.

5. Payment & Refunds

Coaching fees are due as outlined in your individual coaching agreement. All payments are processed securely. Refund policies vary by program and will be clearly stated in your coaching agreement at the time of enrollment.

6. Intellectual Property

All content on www.nieveseffect.com — including text, graphics, logos, program materials, and workout content — is the property of Nieves Effect LLC and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use our content without prior written permission.

7. User Conduct

By using our services, you agree not to:

  • Provide false or misleading information
  • Use our services for any unlawful purpose
  • Harass, threaten, or abuse our staff or other clients
  • Attempt to gain unauthorized access to our systems
  • Reproduce or share our proprietary program materials

8. Limitation of Liability

To the maximum extent permitted by law, Nieves Effect LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid for services in the 3 months preceding the claim.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Hillsborough County, Florida.

10. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. We will update the "Last Updated" date at the top of this page. Continued use of our services constitutes acceptance of the revised terms.
